1. Purpose, Scope, and Regulatory Intent

Classic Mini Parts (“we,” “us,” or “our”) is committed to lawful, transparent, and ethical electronic communications. This Anti-Spam Policy establishes mandatory global standards governing all Commercial Electronic Messages (“CEMs”) sent by or on behalf of Classic Mini Parts.

This Policy is designed to comply with, and in many cases exceed, the requirements of:

  • UK Privacy and Electronic Communications Regulations (PECR)
  • UK GDPR and EU GDPR
  • EU ePrivacy Directive
  • U.S. CAN-SPAM Act
  • Canada’s Anti-Spam Legislation (CASL)
  • Australia’s Spam Act 2003

Where multiple laws apply, the most protective standard for the recipient shall govern.

This Policy evidences Classic Mini Parts’ good-faith compliance, accountability, and risk-mitigation posture for regulators, courts, and enforcement authorities worldwide.

2. Definition of Commercial Electronic Message (CEM)

A Commercial Electronic Message (CEM) is any electronic message that encourages participation in a commercial activity, whether directly or indirectly.

CEMs include, without limitation:

  • Marketing or promotional emails
  • Product announcements, offers, or discounts
  • Newsletters with promotional content
  • Affiliate or referral communications
  • Messages directing recipients to a commercial website

CEMs may be transmitted via email, SMS, MMS, instant messaging platforms, or functionally equivalent technologies.

For CASL purposes, any message sent to, from, or accessed in Canada is treated as a CEM unless a statutory exemption applies.

3. Lawful Basis and Definition of Consent

3.1 Lawful Basis (GDPR / UK GDPR)

For purposes of Articles 6 and 7 of the UK GDPR and EU GDPR, Classic Mini Parts processes personal data for electronic marketing solely on the lawful basis of Consent, unless another lawful basis is expressly permitted by applicable law.

3.2 Definition of Consent

Consent means a freely given, specific, informed, and unambiguous indication of the recipient’s wishes, demonstrated by a clear affirmative action.

Consent must:

  • Be obtained before any CEM is sent
  • Clearly identify Classic Mini Parts as the sender
  • Specify the nature and purpose of communications
  • Be separate from other terms and conditions
  • Not rely on silence, inactivity, or pre-checked boxes

This standard satisfies the requirements of GDPR Articles 4(11) and 7 and CASL Section 6(1)(a).

4. Express Opt-In Requirement (Global Standard)

Classic Mini Parts requires express opt-in consent as its default global standard.

  • Implied consent (including existing business relationships or conspicuous publication) is not relied upon, except where explicitly permitted by law
  • Where implied consent is legally permitted, it is strictly time-limited and documented
  • Consent is never a condition of purchase

This approach is adopted to mitigate regulatory exposure, including CASL administrative monetary penalties of up to CAD $10,000,000 per violation for organizations.

5. Unsubscribe Requests and Withdrawal of Consent

5.1 Definition of Unsubscribe Request

An Unsubscribe Request is any clear indication that a recipient no longer wishes to receive CEMs, including:

  • Clicking an unsubscribe link
  • Replying with an opt-out request
  • Contacting Classic Mini Parts directly

Under GDPR, an Unsubscribe Request constitutes a withdrawal of consent pursuant to Article 7(3).

5.2 Processing and Suppression Obligations

  • Every CEM includes a clear, prominent, and functional unsubscribe mechanism
  • Unsubscribe Requests are honored within five (5) business days, exceeding CASL’s statutory maximum of ten (10) business days
  • Once processed, the recipient is placed on a perpetual suppression list

Suppressed contact details are retained solely for compliance, audit, and legal defense purposes and are never reused for marketing.

6. Message Identification and Transparency

All CEMs must:

  • Accurately identify Classic Mini Parts in the “From,” “Reply-To,” and routing information
  • Use truthful, non-misleading Subject lines that reflect the actual content
  • Clearly disclose the commercial nature of the message where required by law
  • Include valid contact information for Classic Mini Parts

These requirements align with CASL Section 6, CAN-SPAM, and PECR transparency obligations.

7. Prohibited Practices

Classic Mini Parts strictly prohibits:

  • False or misleading header information
  • Deceptive or click-bait subject lines
  • Address harvesting, scraping, or purchased lists
  • Domain spoofing, masked identities, or misleading routing
  • Any practice designed to evade spam filters or misrepresent origin or intent

Such practices are treated as material compliance violations.

8. Record-Keeping, Accountability, and Audit Trails

In accordance with GDPR Articles 5(2) and 30 and CASL compliance expectations, Classic Mini Parts maintains documented records including:

  • Date, time, and method of consent capture
  • Source forms, URLs, or systems used
  • IP address or technical identifier (where applicable)
  • Copies or logs of CEMs sent
  • Unsubscribe and suppression actions

Records are retained for legally appropriate periods and made available for audits, investigations, or regulatory inquiries.

9. Data Subject Rights (GDPR)

Nothing in this Policy limits data subject rights, including:

  • Right of access
  • Right to rectification
  • Right to erasure
  • Right to restriction of processing
  • Absolute right to object to direct marketing (Article 21(2))

Any objection to direct marketing is enforced immediately and permanently.

10. Third-Party, Vendor, and Affiliate Communications

Classic Mini Parts does not authorize third parties to send CEMs on its behalf without written approval and binding compliance obligations.

  • Third parties must adhere strictly to this Policy and applicable law
  • Classic Mini Parts disclaims liability for unauthorized third-party mailings conducted without its knowledge or consent
  • Non-compliant vendors or affiliates may be audited, suspended, or terminated

11. Enforcement and Consequences

Violations of this Policy may result in:

  • Immediate termination of access or contractual relationships
  • Disciplinary action
  • Legal remedies
  • Referral to regulators or enforcement authorities

13. Severability

If any provision of this Policy is held unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

14. Choice of Law and Jurisdiction

This Policy is governed by the laws of England and Wales, without regard to conflict-of-laws principles, except where mandatory local law requires otherwise.

15. Policy Revisions and Change Log

Classic Mini Parts reserves the right to amend this Policy at any time. Updates will be posted with a revised effective date.
